Is it possible to file a lawsuit against U.K. border force for aiding and abetting human trafficking?
As per recent news the home office fined a couple for failing to “check that no clandestine entrant was concealed” when an illegal migrant had hidden themselves inside the couples camper van.
If a civilian couple can be fined for unknowingly transporting an illegal migrant, how can border force not be prosecuted for collecting them from the sea border and transiting them back to U.K. shores?
Under s2 of the Modern Slavery Act 2015, a person commits the offence of human trafficking “if the person arranges or facilitates the travel of another person (V) with a view to V being exploited”. 2 People do not have be transported across borders for trafficking to take place.
By collecting these illegal migrants who are known to be trafficked individuals they are facilitating said trafficking, making it easier and safer to make the journey in small boats only encourages more people to make that journey, which ultimately plays into the hands of the traffickers (aiding and abetting).
France also are doing the same by allowing trafficked individuals to illegally camp within their territory without applying for immigration status in France with the sole purpose of transiting the North Sea to arrive in Britain.
Usually they would deport those without a legal immigration status/application, so by allowing these trafficked individuals to camp illegally in a location that offers the the best opportunity to procure small boat transit to the U.K. they are, in my opinion going against “Directive 2011/36/EU - Article 3” aiding and abetting the trafficking of people.
