The Proposal
Explaination
This section mostly just reinstates the norm before the creation of the Supreme Court in 2009. By ensuring that the top of the judiciary in in Parliament, we hopefully crack down on activist judges. From a point of principle, the UK constitution is built on the principle of the fusion of powers. This prevents fights between branches of government and encourages everyone to work together, because all sides are ultimately answerable to Parliament. It also makes a lot of sense in a common law system to have your judges in Parliament, because only by being there can they be reminded why the law is, and can they be prevented from usurping the powers of Parliament.
The only exciting thing this does otherwise is make the Great Council a court for cases of heraldry. Currently, as I understand it, it is the Privy Council which hears these cases and the Great Council just seems more appropriate.
