I’m a bit confused and looking for some input from people with a better understanding of the law than myself please.
- Abu Wadee, 33, also known as Mosab Abdulkarim Al-Gassas entered the UK on a dinghy on the 6th of March 2025.
- As per protocol he will have destroyed his documents and claimed asylum at the point of arrival and was duly shipped to an asylum hotel in Manchester.
- Following his arrival the MSM ran stories about his support for Hamas and desire to kill jews.
- Given the uproar the authorities had no alternative but to act and he was arrested.
- When he went to court he was charged with ‘entering the country on 6 March without leave or valid entry clearance.’
- There were no other charges and he was jailed for 9 mths.
So my question is this. It seems that he was sent to jail based on the 1971 Illegal Immigration Act and nothing else. His claim for asylum didn’t prevent his prosecution, because he was deemed to have ‘entered the country without leave or valid entry clearance’. Given the fact that every small boat arrival turns up with no documents and claims asylum on arrival, why aren’t they detained for ‘entering the country without leave or valid entry clearance.’?
